RENT IT RENTAL POLICY 

PLEASE NOTE THAT THESE ARE IMPORTANT CONDITIONS AFFECTING YOUR RIGHTS AND SHOULD BE READ CAREFULLY. 

This rental policy constitutes a legal agreement entered into between the Renter and Rent It (as defined below) and shall apply to all rental orders placed through Rent It. This agreement incorporates by reference Rent It’s Terms & Conditions Click Here and Privacy Policy Click Here. 

 

Definitions 

In this Agreement, unless the context indicates otherwise: 

• “Article” means those luxury designer articles of clothing or fashion accessories offered for rental by Rent It and in respect of which the Renter has ordered the rental thereof; 
• “Damages” (in relation to an Article) means the actual expenditure in repairing any damage, replacing any parts and/or elements, or any other charges incurred related to an incident of whatsoever nature; 
• “Daily Rental Rate” means the daily rental charges chargeable for the Article during the Rental Period as communicated to the Renter via a confirmatory email by Rent It; 
• “Rent It” means Rented Lifestyle (Private) Limited a private limited company incorporated under the laws of Pakistan and having its registered office at 33-F/A, Sarwar Road, Lahore Cantt, Pakistan; 

• “Rental Period” means the period between the date of requested delivery and the termination date and time or if such period is extended, the time and date entered on Rent It’s records of the rental in each case as communicated to the Renter via a confirmatory email by Rent It; 
• “Renter” means all of the persons, jointly and severally, who are purchasing rental of an Article from Rent It; 
• “Return Date” means the date communicated to the Renter via a confirmatory email by Rent It; 
• “Total Loss” (in relation to an Article) means (I) Damages where the estimated costs of repairs are such that the Article is in the sole and absolute discretion of Rent It uneconomical to repair in relation to the value of the Article and condition of the Article for the time being; or (II) when the Article is stolen and/or lost. The amount of the Total Loss will be the 100% of the retail value reasonably determined by Rent It as at the date of loss; and 
• “Wearer” means such person who is duly authorized by Rent It to wear/carry the Article. In the event that the Renter is not the Wearer, the Renter shall notify Rent It prior to rental of the Article of such fact and shall identify the Wearer. 

Rental 

• Rent It rents to the Renter, who hires the Article subject to the terms and conditions applicable at the time of the rental as set forth herein. The Renter will be bound by these terms and conditions, whether they are the Wearer or not. If the Renter is not the same person as the Wearer, it shall be the Renter’s responsibility to procure that the Wearer complies in full with these terms and conditions. 
• All rentals from Rent It is subject to the availability of the requested Article. 
• Rent Its general policy is to limit Renters to 4 (four) products at any given time (not including backups for sizing), although Rent It reserves the right at any time to increase or decrease this number, with respect to any or all Renters. 
• Following the booking on the Rent It website and prior to the booking being finalized, the Renter shall share its (as well as that of the Wearer if Wearer and Renter are not the same) CNIC Card or other appropriate forms of identification (as determined by Rent It) following which a verification video call shall be conducted with Renter to confirm Renter is the same person Rent It team has been in contact with and who’s ID card details etc. have been provided – no booking will be considered final until this verification step is completed; 

Cancellation of Rental Order 

• Any rental orders placed with Rent It shall be legally binding. 
• For pre-paid orders, items may be cancelled by the Renter as per the following conditions. For Cancellations: 
• Payment will not be refunded but will apply as credit for the next order. 
• For Cash on Delivery orders, items may be cancelled by the Renter however it is important to note that it will affect Renter’s eligibility for future Cash on Delivery orders. Cancellations: 

• The advance will not be refunded but will apply as credit for the next order. 
• Credit may be used exclusively for future rental of an item from Rent It and shall expire if not used in the 12 (twelve) months following issuance. 
• Refunds will be issued in the same form as the original payment. 

Delivery 

• Rent It shall deliver to the Renter the Article (directly or through a courier partner) ordered by them in accordance with their selected design and size specifications, on or prior to the requested delivery date. In the event that the Article is not delivered by the requested delivery date, the Renter shall be entitled to a refund of rental costs and charges, without any further obligation or liability on the part of Rent It. 

• Delivery of an Article shall be made to the address indicated by the Renter. Rent It reserves the right to refuse delivery to a post office box or to any other location at which a person is not available to accept physical delivery. Deliveries shall be subject to any additional terms indicated on Rent It’s the website. 
• Delivery and transfer of the risk in and to the Article shall occur at the time and place that the Renter or their duly authorized representative, or the Wearer, takes possession of the Article, either at the Renting Location in the event of personal pick-up, or at the delivery address specified by the Renter when placing their rental order. It shall be the Renter’s responsibility to ensure timely collection and/or physical reception of any Article from their requested delivery address. In no event shall Rent It be liable for any delays or costs resulting from the Renter’s failure to receive delivery of an Article at their requested delivery address. 
• The Article shall be deemed to have been delivered to the renter or their duly authorized representative or the Wearer in good order and repair, clean and without any damage unless otherwise recorded in writing and signed by Rent It (or its a delivery agent) and the party accepting delivery of the Article. 

Use of Article 

• The Article shall be used exclusively by the Renter (or by the Wearer, if different from the Renter). Any use of the Article by any person shall not be permitted without the prior written authorization of Rent It. 

• The Article may be used only for the Rental Period or any extended period as agreed to by Rent It. The Renter agrees that any extension so noted on Rent Its records would correctly reflect such extended period as agreed to by Rent It. 
• The Article shall at no time be considered or constitute the property of the Renter or Wearer and the Renter or Wearer shall not alienate the Article or further lend, rent, loan or allow usage of the Article by any person other than the Renter without Rent It’s express prior written permission. 

Return of Article 

• The Renter shall return the Article to Rent It at the end of the Rental Period at the location of original delivery (unless otherwise agreed to by Rent It) and in the packaging and form provided and indicated by Rent It to the Renter. 
• The Renter acknowledges that failure to return the Article as set forth in this Agreement shall constitute illegal possession by them, and Rent It may repossess the Article wherever same may be found and from whomsoever is in possession thereof. Any costs incurred by Rent It to retrieve the Article will be for the account of the Renter. Moreover, Rent It reserves the right to charge a penalty for failure to return any Article on time.  

• If the Article is not returned by the Renter to Rent It by the Return Date, the same shall be considered a material breach and cause significant monetary and reputational damage to Rent It. As such, the Renter shall be liable to pay Rent It additional rental amounts for each day of delay beyond the Return Date by applying a 20% increase on the Daily Rental Rate (the “Daily Additional Rental Amount”). The Daily Additional Rental Amount shall separately apply on each day of delay in returning the Article beyond the Return Date until the date of the actual return of the Article to Rent It and shall be payable by the Renter to Rent It upon demand. The foregoing reflects the actual monetary damage that would be suffered by Rent It in the event of delay in the return of the Article as Rent It would be liable to pay the said amount to the owner of the Article. 
• In the event the Article is lost, stolen or damaged beyond reasonable repair rendering the Article unusable in the manner and style intended for articles of this nature or the damage has resulted in a significant decrease in the Retail Value of the Article, the Client shall be liable to compensate Rent It for such loss, damage and/or theft of the Article. Rent Its invoice for the compensation shall be based on prevailing market prices and shall be conclusive in this respect. 
• The Article shall be returned to Rent It in the same condition as received, that being undamaged and in good condition, ordinary wear and tear excepted. 
• The Articles rented by the Renter shall be returned to Rent It no later than the Return Date mentioned above in fit and proper condition in the original state as delivered/handed over to the Renter/Wearer by Rent It. 

Delivery and Return SOPs 

• The following SOPs must be followed by the Renter and Wearer otherwise it will be a material breach of this Agreement. 
• The article shall be packed in custom Rent It packaging which packaging will be sealed with four Rent It circular seal stickers of white color (the “Rent It Package”). 
• The Rent It Package shall also include four extra Rent It circular seal stickers of black color. 
• Only the Renter is authorized to unpack the courier service package. 
• Renter shall be required to make a video of the Renter unpacking the courier packing, breaking the Rent It seals on the Rent It Package and examining the Articles upon unpacking. 

• The video shall be sent by the Renter to the Rent It WhatsApp account. 
• Failure to do so shall be a breach by the Renter and the Renter shall be liable for any damage or loss discovered at any point in time after initial dispatch to Renter. 
• After using the Article and prior to the Return Date, the Renter shall pack the Article in the Rent It Packing and seal the same (in the same manner) with the four extra Rent It circular seal stickers of black color sent in the Rent It Package. 
• Renter shall dispatch the returned Rent It Package with the Article inside via the same courier service used by Rent It with an outer packing of the courier service. 

Termination/Cancellation/Extension of Rental/Purchase 

• Notwithstanding anything to the contrary contained herein, Rent It shall be entitled in its sole and absolute discretion to terminate this Agreement at any time by notice (verbal or in writing) to the Renter, whereupon the Renter shall immediately return the Article to Rent It. In the event of such failure to return the Article to Rent It, Rent It shall be entitled to recover possession of the Article, wherever found and from whosoever has possession thereof. The obligations of the Renter and the rights of Rent It shall continue in full force and effect until the Article has been returned to Rent It in terms of this Agreement and the Renter has complied with all his obligations. Any costs incurred by Rent It to retrieve the Article will be for the account of the Renter. 
• The Renter shall give Rent It 24 hours’ notice, prior to the termination of the Agreement, of their intention to extend the Rental Period. The Rental Period shall be extended on acceptance by Rent It of the extended Rental Period requested by the Renter. 
• Rent It may at its discretion offer the Renter the right to purchase the Article, in which case the Renter shall pay to Rent It such additional amounts as may be agreed between Rent It and the Renter. Any purchases by the Renter of any Article shall be on an “as is” basis, without any warranty express or implied, and shall be final and non-refundable. 

Renter/Wearer 

• The Article may only be worn by the Wearer. 

• If the Renter and Wearer are not the same people, then, without derogating from any rights or remedies which Rent It may have, the Renter shall remain liable for all their obligations in terms of this Agreement and in particular, they shall be liable to Rent It as if they had been wearing the Article. 
• The Renter warrants that they are entitled and have the capacity to enter into this Agreement, that all particulars were given to Rent It are true and correct. 

Rental Rates and Charges 

• The Renter agrees to pay Rent It the rental rates plus all other charges and fees opted for or utilised by the Renter as contemplated up until the Article is returned to Rent It, as per the rates indicated on Rent It’s a website or as otherwise communicated to the Renter. 
• Rental rates, charges and fees will be calculated for the whole of the rental period (including any extended period as agreed by Rent It) at the rates and on the basis set out by Rent It. The Renter shall also be liable for all costs incurred by Rent It (including, without limitation, all fees of lawyers and other advisers) in recovering any outstanding expenses not paid by the Renter.  

Payment 

• All payments are due on demand. Payment for rental of an Article shall be payable at the time of placing a rental order (unless otherwise agreed in writing by Rent It). All charges payable by the Renter shall be payable by credit card unless the Renter has a valid credit account with Rent It, in which case the Renter may use its credit as payment. 
• Rent It may at its absolute discretion elect to accept cash payment for a rental, in which case a cash handling fee may be charged by Rent It. Rent It may also, at its absolute discretion, elect to accept payment by other means, such as PayPal for example. 
• The Renter will not be entitled to set off or withhold payment of any amounts due in terms of this Agreement for any reason whatsoever. 
• If Rent It has agreed to accept payment from the Renter by credit card or charge card, the Renter’s acceptance of this Agreement will constitute irrevocable authority for Rent It to obtain authorization and/or payment. This will also constitute irrevocable authority for the issuer of the card to debit them with the total amount due to Rent It including but not limited to any late penalties, Damages and/or Total Loss suffered by Rent It. Such authority shall extend to cases where the price for renting an Article is zero. 

• In the event of an incident and/or if the Article is stolen and/or lost, the amount of the Damages and/or the Total Loss as suffered by Rent It is payable by the Renter immediately on demand by Rent It. 
• If the Article is not returned by the Renter to Rent It by the Return Date, the same shall be considered a material breach and cause significant monetary and reputational damage to Rent It. As such, the Renter shall be liable to pay Rent It additional rental amounts for each day of delay beyond the Return Date by applying a 20% increase on the Daily Rental Rate (the “Daily Additional Rental Amount”). The Daily Additional Rental Amount shall separately apply on each day of delay in returning the Article beyond the Return Date until the date of the actual return of the Article to Rent It and shall be payable by the Renter to Rent It upon demand. The foregoing reflects the actual monetary damage that would be suffered by Rent It in the event of delay in the return of the Article as Rent It would be liable to pay the said amount to the owner of the Article. 
• A certificate of any director, manager or accountant of Rent It as to any amount owed by the Renter to Rent It shall constitute prima facie proof of that amount. 

Packages 

• Renters may purchase packages as indicated on Rent It’s a website. Credits offered for purchase shall be redeemed for the relevant monetary value, exclusively through orders placed with Rent It. All credits are non-refundable, non-transferable, and shall expire and lapse if not redeemed within 1 (one) year from issuance. 

Renter’s Risk and Liabilities 

• The Renter shall assume the sole risk of the Article (ordinary wear and tear excepted) from the time that the Article is handed to the Renter/Wearer until such time as the Article is returned, in accordance with the terms of this Agreement. 

The incident in Relation to the Article 

• If at any time the Article is involved in an incident, damaged, stolen and/or lost, the Renter shall take every reasonable precaution to safeguard the interest of Rent It, and failure to do so will result in the Renter being liable for Total Loss. 
• The Renter shall notify Rent It upon return of the Article of the occurrence of any incident or damage in relation thereto. In the event that the Article is stolen or lost, the Renter shall within twenty-four hours of the occurrence notify Article of such incident, and shall, if requested by Rent It, cooperate with Rent It in reporting such incident to the police. 

• The Renter shall, if requested by Rent It, co-operate with Rent It and its insurer in any investigation, the making or instituting of any claim or action and the defence of any prosecution, claim or action relating to any accident, theft or damage. If the Renter is not the Wearer, then, without in any way derogating from the Renter’s obligations in terms of this agreement, the Renter shall procure that the Wearer complies with the foregoing provisions and the Renter warrants that the Wearer shall do so. 

Limitation of Liability/ Indemnity of Rent It by Renter 

• Neither Rent It nor any of its directors, officers, employees, service providers or agents shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from the rental by the Renter of the Article, including, without limitation, any defect in the Article (howsoever arising and of whatever nature) and whether such loss or damage results from a breach of contract or negligence or gross negligence or otherwise which may be suffered by the Renter, Wearer and/or any third party. 
• Rent It, its directors, officers, employees, affiliates or agents are accordingly indemnified by the Renter against any claim of any nature whatsoever and howsoever arising from any damages or loss which might be instituted against Rent It, its directors, officers, employees, affiliates or agents arising from or connected with or pursuant to the renting of the Article contemplated in this Agreement.  

General 

• This document contains the entire agreement between the parties regarding the matters contained herein and no party shall be bound by any undertakings, representations, warranties, promises or the like not recorded in writing by Rent It. 
• If any provision of this agreement is found by a court of law to be invalid or void such provision will be severed from the agreement, without affecting the remainder of the provisions hereof. 
• No extension, latitude or other indulgences that may be given or is allowed by any party in respect of the performance of any obligation hereunder, and no delay or forbearance in the enforcement of any party arising from this agreement, and no single or partial exercise of any right of any party under this agreement will in any circumstances be construed as implied consent or election by such party or operate as a waiver or a novation of or otherwise affect any party’s rights in terms of or arising from this agreement or stop or preclude any such party from enforcing at any time and without notice, strict and punctual compliance with each and every provision or term hereof. 
• This agreement and all matters or disputes arising therefrom or incidental thereto shall be governed and construed in accordance with the laws of the Islamic Republic of Pakistan. The Renter consents to the jurisdiction of the courts of competent jurisdiction in Lahore, Pakistan with respect to any disputes arising out of this Agreement.
